PROBATIONARY PERIOD: Completion of a one-year probationary period may be required.
DUTIES: The incumbent serves as a Paralegal Specialist in the Financial Litigation Unit (FLU). He/she is responsible for the activities and technical guidance of the Unit which involves the collection of civil and criminal judgments, restitution due to the U.S. Government, pre-judgment and post-judgment claims, bankruptcy cases, and other affirmative litigation cases. Performs all legal work related to collection activities, such as analyzing facts in each case, evaluating approaches and legal issues, researching legal opinions, recommending a legal course of action, drafting legal pleadings and assisting attorneys in preparation for trial. Serves as the district’s expert on the overall collection process and independently handles debt collection claims referred from client agencies. Incumbent has intimate knowledge of the administrative processes which support all collection activities, from the initial review of claims for compliance with the Federal Claims Collections Standards to making independent determinations as to the cost effectiveness of pursuing the obligation, either by way of suit or proceedings subsequent to the entry of judgment to enforce collection. Develops, updates and maintains forms and pleadings used by the FLU pursuant to Local Rules and practices of the district. Provides technical guidance to debt collection agents handling primarily criminal fine cases. Ensures proper interpretation and enforcement of criminal judgment and commitment orders and that debt collection agents perform all functions to collect amounts imposed as a result of the prosecution of criminal cases. Analyzes and reviews work products generated by the FLU. Provides procedural and technical guidance with regard to both court procedures and documents. Instructs and trains debt collection agents so that maximum productions will be realized.
